Washington, DC – Thursday, May 22, 2025 – ClearPath Action released the following statement after the House passed its budget reconciliation package, H.R.1, the One, Big, Beautiful Bill Act.
“This legislation preserves some key energy provisions for technologies like advanced nuclear and carbon capture, but it is insufficient to support energy producers to meet growing demand,” said
ClearPath Action CEO Jeremy Harrell. “We look forward to working with House and Senate Republicans to preserve and further expand these key incentives that unlock American energy dominance and let America build.”
Over the last week, House Republicans made a change to improve tax credits for new nuclear energy, retaining the tech-neutral credits, 48E and 45Y, for nuclear projects that begin construction by the end of 2028. While improved, the date would need to be extended beyond 2028 for most new nuclear projects to qualify, as most are expected to move forward in the early 2030s.
A number of Congressional Republicans, the Trump Administration, and Republican Governors are continuing to champion several existing tax incentives, which are critical for unleashing American energy dominance.
- Department of Energy Secretary Chris Wright said he would like to see “very favorable treatment” from the federal government for nascent geothermal and nuclear technologies. “My personal goal would be to much more rapidly sunset the technologies that have been around and have been living on decades of subsidies, and then have a window — maybe 15 years from now, 16 years from now, 10 years after we can get stuff built — where we have very favorable treatment for ... I would target nuclear and geothermal,” he said. “I’m in favor of every nudge, every incentive we can get from the federal government to restart this industry.”
- Govs. Mike Braun (R-IN) and Henry McMaster (R-SC) each sent a letter to Congressional leadership, urging them to keep federal incentives for new nuclear plants in place.
- Rep. Jen Kiggans (R-VA) introduced, along with cosponsors Reps. Andrew Garbarino (R-NY), David Valadao (R-CA), Mark Amodei (R-NV), Dan Newhouse (R-WA), Buddy Carter (R-GA), Mike Lawler (R-NY), Juan Ciscomani (R-AZ) and Nick LaLota (R-NY), H.R. 3291, the Certainty for Our Energy Future Act. The legislation preserves incentives for innovative, clean baseload technologies like advanced nuclear and next-generation geothermal, while phasing out incentives beginning in 2030 for mature technologies like wind and solar.
- Sens. John Curtis (R-UT), Lisa Murkowski (R-AK), Thom Tillis (R-NC) and Jerry Moran (R-KS) sent a letter to Senate Majority Leader John Thune (R-SD) highlighting the importance of maintaining existing incentives to support President Trump’s efforts to reshore manufacturing and secure supply chains.
- Rep. Dan Newhouse (R-WA) sent a letter along with 26 House Republicans to House Ways and Means Chairman Jason Smith (R-MO) in support of energy tax credits for advanced nuclear deployment.
- Rep. Andrew Garbarino (R-NY) sent a letter along with 20 House Republicans to House Ways and Means Chairman Jason Smith (R-MO) in which the Members stated [the energy credits] “would be jeopardized by premature credit phase outs or additional restrictive mechanisms such as limiting transferability.”
- Rep. Mariannette Miller-Meeks (R-IA) sent a letter along with 11 House Republicans urging House Ways and Means Committee Chairman Jason Smith (R-MO) to protect the Clean Electricity Investment Tax Credit (ITC), Section 48E, and Clean Electricity Production Tax Credit (PTC), Section 45Y.
- Rep. Juan Ciscomani (R-AZ) sent a letter along with 5 House Republicans to House Ways and Means Committee Chairman Jason Smith (R-MO) urging the Committee “to maintain the manufacturing incentive known as Section 45X in its current form.”
